By downloading, installing, or using the Ares Protocol: Hybrid Athlete mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of those changes.

2. Description of Service

Ares Protocol: Hybrid Athlete is a fitness application that provides:

• AI-generated personalized workout programming
• Training across multiple disciplines (CrossFit, HYROX, Bodybuilding, Powerlifting)
• Workout logging and performance tracking
• Competition preparation tools
• Lifestyle and recovery monitoring
• AI coaching and advice

3. Subscription and Payments

Subscription Terms

• The App offers a subscription service at $19.99 USD per month
• New users receive a 7-day free trial
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase

Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

4. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Intellectual Property Rights

Our Content

All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Ares Protocol or its content suppliers and is protected by international copyright laws.

Trademarks

The Ares Protocol name, the Ares Protocol logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ares Protocol. You may not use such marks without our prior written permission.

User Content

You retain ownership of any content you submit to the App (such as workout notes). By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content to provide our services.

6. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute our content without permission
• Use the App to transmit malicious code
• Impersonate any person or entity
• Share your account credentials with others

7. Health and Fitness Disclaimer

IMPORTANT: The App provides fitness information and AI-generated workout programs for educational and informational purposes only. This content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

• Always consult with a qualified healthcare provider before starting any exercise program
• Stop exercising immediately if you experience pain, discomfort, or other warning signs
• The AI-generated workouts are based on the information you provide and may not account for all health conditions
• You assume all risks associated with using the workout programs

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The results from using the App will meet your requirements

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARES PROTOCOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors or omissions in any content

10. Indemnification

You agree to indemnify, defend, and hold harmless Ares Protocol and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
